Controversial National Super Alliance (NASA) politician, Babu Owino, has appealed High Court ruling that invalidated his August 8, 2017 election as member of Parliament for Embakasi East constituency.
In his notice of appeal filed on Wednesday, March 7, Owino said he was not satisfied with the High Court decision on the election petition that was filed by Jubilee Party's candidate Francis Mureithi challenging his victory, TUKO.co.ke can confirm.

High Court on Friday, March 2, 2018 declared null and void election of Owino as MP for Embakasi East constituency.

While ruling on the petition, High Court Judge Joseph Sergon said the election was not conducted in a free and fair environment.
The judge ordered Owino to pay KSh 5 million in costs and directed Independent Electoral and Boundaries Commission (IEBC) to conduct fresh poll in Embakasi East.

Interestingly, vote recount that was ordered by the same court had shown that Owino garnered more votes than his rival Mureithi.
Report by High Court deputy registrar, seen by TUKO.co.ke on Monday, February 26, showed Owino had 46,817 votes against Mureithi' 42,501 votes after the vote recount exercise.

Judge Sergon, however, held that it was impossible to verify results in several polling stations and that the election was not a free and fair.
